A False Claims Act lawsuit against 3M alleged the company knew its Combat Arms Earplugs, Version 2 were defective but sold the product to the military without disclosing this information. The dual-ended earplugs were supposedly designed to protect soldiers’ from exposure to loud combat noises such as explosions and gunfire while allowing them to hear spoken words and commands.
The design, however, was allegedly defective, causing the earplugs to loosen in a soldier’s ear and exposing them to loud noises, potentially causing hearing loss and tinnitus. The earplugs were issued to military members who served in Iraq and Afghanistan between 2003 and 2015.
