Every state has a “statute of limitations” outlining when an injury victim must file a personal injury claim before they lose their right to recover compensation. According to the Texas Civil Practice & Remedies Code section 16.003, the statute of limitations for personal injury cases in Texas is two years. Damages You Can Recover in a Personal Injury Case

There are three types of damages available for injury victims to pursue in a personal injury case. “Damages” is a legal term used to describe the items an injured person can pursue compensation for after an accident.

These damages are economic, non-economic, and punitive damages. The first two damages also called general and special damages, are responsible for compensating the injury victim for losses such as lost wages, medical expenses, and pain and suffering. Together, special and general damages are known as “compensatory damages,” that is, damages responsible for compensating the injured party for as many losses as possible.

The last type of damages, punitive damages, differ from the first two in that their main purpose is to punish the at-fault party rather than compensate the injured party. As such, punitive damages are not often awarded in personal injury cases.
