According to a statement released earlier this month, a recent suspension of employees for reporting their workplace injuries has prompted a lawsuit and has been initiated by the U.S. Department of Labor. The Ohio Bell Telephone Company – more commonly known as AT&T – is reported to have wrongfully suspended 13 employees without pay. The employees were allegedly suspended without pay for reporting injuries that they sustained while at work from 2011 to 2013.
Under the Occupational Safety and Health Administration Act of 1970 (OSHA), employees are protected from workplace retaliation if they step forward and report any injuries that occurred while they were on the job. The complaint brought against AT&T alleges that 13 different employees on separate occasions were disciplined with 1 to 3 days of unpaid suspension for reporting their injuries.
This retaliation against injured workers is illegal, and the lawsuit seeks to hold AT&T responsible for their actions and prevent such incidents from occurring again. Under OSHA, employers have a responsibility to provide their employees with safe and healthful workplaces. The lawsuit, filed in the Eastern Division of the U.S. District Court for the Northern District of Ohio, states that AT&T violated the whistleblower provisions of OSHA.
