Attorney Guerra Secures Not Guilty Verdict For Client

A Friendly Favor

Our client was a McAllen police officer in good standing and a single mother, who had suffered neck and back injuries after being struck by a drunk driver several years ago. She had been treated regularly by a chiropractor, and the two became friends after years of treatment. Our client mentioned to that she intended to visit San Antonio for her sister’s birthday, at which point the chiropractor asked her to bring two of his relatives with her. She agreed, and headed toward San Antonio with her two children and the two women.

A Victim of Deceit

Since our client had previously driven the man’s daughter to Houston, she had no reason to believe that there would be any issues. The party reached the Falfurrias checkpoint on Jun 16, 2015, and were detained by Border Patrol agents after the two women refused to answer questions about their citizenship. As it turned out, neither woman was legally in the United States. Furthermore, it was later discovered that they were not even relatives of the chiropractor who had asked for the favor. She was arrested, and was charged with two counts of alien smuggling.

A Fair & Just Verdict

Our client faced up to 10 years in prison for each count, in addition to hefty fines. The jury agreed with our assertion that our client was essentially a victim in this crime, as she was betrayed by someone she thought was a friend. The jury agreed, and acquitted our client on both counts. Attorney Guerra was pleased with the result, commenting that “This was a fair and just verdict that will with Joan her life back.”
