Specific Circumstances of Bribery

The following circumstances can still be considered bribery in Texas:

  • The bribe recipient was not actually in a position perform the agreed upon action.

  • In the case of bribing a public servant, the benefits or money were not given to the recipient until he or she ceases to be a public servant.

Bribery is always considered a second degree felony in Texas, which comes with a maximum of 20 years in prison and a fine of no more than $10,000. These penalties vary if your alleged bribery offense is a considered a federal charge.
