Manslaughter Laws in Texas

Under Texas law, the crime of killing another person is defined as criminal homicide. It is recognized that some killings are premeditated or are committed intentionally under the influence of a heat of passion, and homicide cases are referred to as murder. Not all homicides, however, are murders. In the event that the perpetrator of a homicide commits the act through some type of recklessness, the crime is charged as manslaughter.

Penalties for Manslaughter

The violent crime of manslaughter is a felony of the second degree, the sentence for which ranges from a minimum of 2 years and up to 20 years in prison and up to $10,000 in fines. Common examples of situations in which manslaughter would be charged include fatal traffic collisions which are caused by extremely reckless driving, as well as deaths caused by the careless handling of firearms and other killings which are unintentional but for which the defendant may be found to be at fault.

Intoxication Manslaughter in Fatal DWI Collisions

In the event that you have been accused of causing the death of another person in an accident where you were operating an automobile or other vehicle and were driving while intoxicated (DWI), you can be charged with the crime of intoxication manslaughter. This offense is a second-degree felony, with similar penalties to manslaughter.

In order to prove your guilt, the prosecutor will have to demonstrate that you caused the accident by reason of your intoxication, since the fact that you were driving under the influence at the time of the accident is not sufficient to convict you.
