The 3M Dual-Ended Combat Arms Earplugs Version 2 (CAEv2) were standard issue to service members of the U.S. military between 2003 and 2015 for deployment and training purposes. Unfortunately, many of these brave men and women suffered hearing loss and tinnitus as a result of wearing these earplugs.
In July 2018, the Minnesota-based manufacturer was found guilty of knowingly selling defective earplugs to the federal government without disclosing the design defect and through falsified test results. After 3M agreed to pay $9.1 million to resolve these allegations, hundreds of veterans are now filing lawsuits of their own to recover their entitled compensation.
If you’ve experienced hearing issues after using 3M earplugs, our Houston personal injury attorneys at Farah Law can help you obtain the financial compensation you deserve. We appreciate the dedication and sacrifice U.S. soldiers make to protect your land and freedom, which is why we are dedicated to ensuring 3M and any other parties involved are responsible for their disservice to our country.
You may qualify for compensation through a lawsuit if all the following are true:
These dual-ended earplugs had a yellow and black/olive end to provide soldiers with versatile hearing protection. One side is used like a traditional earplug which blocks all types of sound, while the other is supposed to block extremely loud noises such as gunfire and explosions—but also allowing commands and spoken words to filter through.
However, the earplugs were too short for adequate insertion, allowing them to loosen in the wearer’s ear and exposing him/her to hearing loss. Additionally, 3M and its predecessor, Aearo Technologies Inc., allegedly were aware of the design defects back in 2000, after the earplugs consistently failed safety tests.
Service members who wore these defective earplugs suffered two types of hearing problems: tinnitus and hearing loss. Tinnitus is defined as the continuous ringing, buzzing, or hissing in the ears at different levels, often caused by constant exposure to damaging sounds, while hearing loss is the third most prevalent health issue among military personnel.
