Texas Drug Possession

The Texas Health and Safety Code and Texas Controlled Substances Act establishes possession penalties and categorizes drugs into marijuana and five other drug classifications, which include street drugs and prescription drugs possessed without a prescription.

Marijuana possession, which is the least serious drug crime, has the following penalties based on the drug amount possessed:

• 2 ounces—maximum 180 days in jail and/or $2,000 maximum fine
• Over 2 ounces and under 4 ounces—maximum of 1 year in jail and/or $4,000 maximum fine
• Over 4 ounces and under 5 pounds—180 days minimum to 2 years maximum in state prison and/or $10,000 maximum fine
• Over 5 pounds and under 50 pounds—2 years minimum to 10 years maximum in state prison and/or $10,000 maximum fine
• Over 50 pounds and under 2,000 pounds—2 years minimum to 20 years maximum in state prison and/or $10,000 maximum fine
• Over 2,000 pounds—5 years minimum to 99 years maximum in state prison and/or $50,000 maximum fine

With the exception of possessing less than 28 grams of illegal prescription drugs, all other drug possession is subject to Texas felony charges.
