The Texas Health and Safety Code defines delivery as transferring, intending to distribute or selling controlled substances, counterfeit substances or drug paraphernalia. Paraphernalia includes any equipment to manufacture, grow, or use drugs. So, even when giving someone else drugs, directly or indirectly, whether or not monetary exchange occurs, Texas courts view the activity as delivery. Only small amounts of marijuana or prescription drugs are misdemeanors, and overall, drug charges for delivery are felonies which incur much stiffer penalties than mere possession. Penalties for delivery offenses correspond to the amount and type of drug, just as they do with drug possession.

Drug delivery penalties range from misdemeanor B (180 days in jail) and misdemeanor A (1 year in jail) to felony penalties of 2 to 20 years, 5 to 99 years, and 10 to 99 years with fines up to $10,000, $100,000, and $250,000.
