Houston Criminal Defense Attorney Juan L. Guerra, Jr. of Guerra & Farah, PLLC has secured yet another noteworthy dismissal
on a large
drug case. Our client was accused of possession with intent to distribute 60 kilograms
of cocaine which was seized in his vehicle. If convicted the client was
facing a minimum of 15 years and up to 99 years in prison.
This multi-agency investigation involved two confidential informants, one
of whom was at the scene at the time of the arrest.
Mr. Guerra fought for the disclosure of the confidential informants. Agents
involved in the investigation were not willing to disclose the identity
of the confidential informant, which is a constitutional violation of
the confrontation clause. Ultimately, Attorney Guerra legally obligated
the State to identify the confidential informant that was at the scene.
The State was forced to dismiss the case due to the rise of the constitutional
violation of not disclosing the confidential informant. Due to Attorney
Guerra’s efforts, our client was given a fair chance at freedom
against a criminal justice system that was ready to do anything to land
