Aggravated Sexual Assault Definitions

For a sexual assault charge to be defined as "aggravated," it must meet certain requirements. This criteria can be found in Texas Penal Code Sec. 22.021.

A sexual assault is considered aggravated when:

  • Serious bodily harm is inflicted on the victim
  • The victim is placed in fear of their life, of harm, or of kidnapping
  • A deadly weapon is used
  • When a date rape drug is used
  • The accused acted with another individual to commit the crime
  • The victim is under 14 years old
  • The victim is elderly or disabled

Aggravated sexual assault is always considered a first degree felony. There is a minimum prison sentence of 5 years associated with these offenses if a conviction is reached—but tougher penalties are possible depending on the circumstances of the case.
