Texas Drug Crime Penalties

The sentence you could receive if convicted of a drug crime depends on several factors, including:

  • The quantity and specific type of drugs involved;
  • Whether the offense you are charged with violates state or federal laws; and
  • Whether you have any previous convictions on your criminal record.

For example, possession of 2 ounces or less of marijuana is a misdemeanor punishable by a fine of up to $2,000 and 180 days in jail. Possession of up to 4 ounces is punishable by double the fine and up to a year in jail, while possession of up to 5 pounds is a felony punishable by up to 2 years in prison and $10,000 in fines.
